I am proposing an extraordinary writ from the Supreme Court to hear its first ever shared parenting case mandated by the Constitution and proper accountability for the routine violations of basic rights in our nation’s divorce and family courts.

Unlike the standard petitions for writ under Rule 14 of the Supreme Court, I will be filing under Rule 2o. It is a rarely used form of petition “in aid of the court’s jurisdiction.”

In this case I am maintaining that undue obstacles put in the way of parents in our federal and state domestic courts ultimately impair access to our high court contrary to due process and Article III of the Constitution.

I will file for this writ as a parent and victim of retributions by our divorce and family courts but only if a sufficient number join.

You don’t have to be a litigant or victimized parent but you must have incurred some kind of harm from this system to justify your participation.

You can do so at no charge although we rely on donations or purchases by clicking here.

You will join as a separate petitioner and not as a party represented by me. I am not acting as a legal advisor. This is a bold and timely petition seeking greater access for parents before our high court.I will ask that a Special Master be appointed to investigate an epidemic in these courts with hearings held around the country should the Court accept this petition.

I will be publishing a series of posts here at www.leonkoziol.com to explain the content and objectives over the next few weeks.

If a sufficient number of parents or court victims join, I will prepare the petition for viewing. You can retain counsel if you like and a period will be set aside from the time of publication here for you to withdraw your participation in the event you disapprove of any aspect of that completed petition. You can also offer input or modifications but keep in  mind that I have little assistance and resources. My time is better spent here and your time can be ideally applied to viral assistance, recruitment and donations.

For example, 83% of mothers receive custody of their children in divorces. Additionally, men are awarded less support on average than mothers who are awarded support. Parental alienation is a devastating problem affecting millions of families around the world. Unfortunately, much like how we addressed domestic violence several decades ago, we treat parental alienation as a domestic issue rather than as a problem that affects communities, school systems, police and court systems, mental health and financial institutions, and legislative bodies. I will discuss how our social and cultural systems sanction and even promote parental alienation at the expense of our children, and what can be done about it.

Dr. Harman is an Associate Professor of Psychology at Colorado State University and is the Program Coordinator for the Applied Social & Health Psychology Program. She is an accomplished and awarded teacher, and has published many peer-reviewed articles and textbooks on intimate relationships, such as The Science of Relationships: Answers to your Questions about Dating, Marriage and Family. In VA the standard court order includes every other weekend with one parent, normally named the non-custodial parent. The standard order does not include holidays, and even in cases where holidays are exchanged occasionally one parent is left without major holidays with their children (Such as Christmas, birthdays, etc). The non-custodial parent, normally a Father, is named a visitor in their children's lives and restricted to 25 to 30% of yearly time with their child and then ordered to pay child support, often paying about 60% of their monthly income. Our goal is for every fit and loving parent,regardless of their gender, to be able to receive a standard court order of EQUAL custody, 50% time sharing and 50% decision making. In a world meant for equality, we still do not have equality for parents. In a census study from 1993-2014, out of 15,000 custodial parents, only less than 3,000 per year ended up being custodial Fathers. Where is the equality? Where is it stated that one gender is a better parent than the other? Why are our children suffering because the courts refuse equal time sharing? Why should the courts or a judge have the ability to pick one parent over the other, rather than have both parents equally parent the child, much like they did when conceiving the child? I am a family law attorney…
and I have seen first-hand the kind of unfairness that you are complaining about and I know that you are making a very legitimate point.

Every time I sit and observe for even an hour or so in family court, I come out wondering what foreign country have I wandered into. Fathers are on the bad end of some peculiar social forces and norms at this point in our culture and even understanding that it is cultural and social — and not personal — does not make it more bearable for those who are affected. I am not going to cheerlead, or defend the system. It’s wrong and it goes on and on and on.

So, what to do?

Join forces. There is an active “Fathers’ Equal Rights” community that has only started to explore its potential for political and social influence.

One voice is a rant; many voices is public policy. All judges are ultimately accountable to the public, even those that forget that is so.

You can begin by attending your the TFRM Rally this June 17th at your State Capitol.

There simply isn’t any other or better alternative.
